These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your" or "User") and KLA Holdings Limited ("KLA", "we", "us"), the operator of the VelHeart mobile application (the "App"). By downloading, accessing or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
The App is intended exclusively for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the App. By using the App you represent and warrant that you meet this requirement.
The App provides interactive entertainment featuring fictional, computer-generated characters. All characters, conversations, images, videos and voices in the App are generated by artificial intelligence and do not depict, portray or represent real persons. Conversations with characters are fictional role-play and do not constitute advice of any kind. Content generated by AI may be inaccurate, inconsistent or unexpected; we make no warranty as to its quality or suitability.
An account is created automatically when you first launch the App (guest mode) and may be linked to a Google or other supported sign-in method. You are responsible for maintaining access to the credentials linked to your account. Uninstalling the App without linking an account may result in permanent loss of access to your account and purchases.
The App offers auto-renewing subscriptions, consumable virtual coins, and other virtual items, purchased through the app store from which you downloaded the App. Virtual items have no monetary value, are non-transferable, and cannot be exchanged for cash. Except where required by applicable law or the applicable store's refund policy, all purchases are final and non-refundable. Subscriptions renew automatically unless cancelled through your store account settings before the end of the current period. We may modify the price, content or availability of virtual items at any time; changes do not affect virtual items already delivered.
Certain features allow you to create custom characters or generate content from your prompts ("UGC"). You retain responsibility for the inputs you provide. You may not use UGC features to create content that depicts real persons without their consent, minors in any context, or content that is unlawful in your jurisdiction. We may remove content and suspend accounts that violate these rules. You grant KLA a non-exclusive licence to host and process your UGC solely to operate the service.
You agree not to: (a) reverse engineer, modify or create derivative works of the App; (b) use the App through unofficial clients, automation or emulators for fraudulent purposes; (c) exploit bugs or engage in payment fraud; (d) resell or commercially exploit any part of the service; (e) use the App in violation of applicable law.
The App and all content provided by KLA (excluding your inputs) are the property of KLA or its licensors and are protected by intellectual property laws. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for private entertainment purposes.
You may stop using the App and delete your account at any time from Settings, or via our account deletion page. We may suspend or terminate accounts that violate these Terms. Upon termination, your licence ends and virtual items are forfeited without compensation, except where prohibited by law.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may update these Terms from time to time. Material changes will be indicated by updating the date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
